The Tribune – Pakistan SC rejects Gilani’s contempt appeal

The Supreme Court of Pakistan on Friday blew hot and cold while rejecting the appeal of Prime Minister Yousuf Raza Gilani even as the Judicial Commission allowed the ‘Memogate’ whistleblower Mansur Ijaz to record his deposition via video-link with the Pakistan High Commission in London.

In yet another development, the Supreme Court witnessed dramatic exchanges between the Bench and counsel for the ISI, which defied court’s directive to produce 11 ‘missing persons’ said to be in its custody. Having hauled up the Prime Minister for defying the court’s order, the apex court held that it would wait the whole day, if necessary, for the ISI to produce the people.

The ISI counsel finally relented and informed the court that while four of the people in custody were dead, four others were undergoing treatment and the remaining three were held in remote detention centres. The agency offered to produce some of the detenus during the next hearing on Monday.

In a setback to the PM, the Supreme Court today dismissed his appeal and ordered him to appear on Monday for framing of charges. The PM’s counsel, Chaudhry Aitzaz Ahsan, failed to convince the 8-member bench to budge from its position that the PM must write a letter to Swiss authorities to reopen a money-laundering case against the President.

This despite the fact that the President enjoys immunity at home and abroad from criminal proceedings. Besides, the Swiss authorities have already closed the case. His argument that Gilani never willfully showed any disrespect to the court and had acted in good faith on the legal advice he had received, had no impact on the judges.

The PM, if convicted, faces a jail term and disqualification that will plunge the country into political uncertainty. The court appears to be in a tearing hurry and seems inclined to complete the trial of the PM by the end of this month.

Ahsan last week voiced fears that the contempt proceedings would lead to a dangerous institutional face-off. The PPP meanwhile smells a conspiracy with the upcoming Senate polls early next month, that may be torpedoed if the government falls. Asma Jehangir has also expressed her apprehension that partisan decisions are being delivered with disconcerting regularity.

BBC News – Maldives crisis: New leader rejects snap election calls

Saturday, 10 February 2012. New Maldives President Mohammed Waheed Hassan Manik has rejected calls by his predecessor for snap elections as a way of resolving a political stand-off.

Mr Waheed told the BBC that the current environment was not conducive to holding “free and fair” elections.

Meanwhile, the US said it would work with the new government but was seeking clarification on the transfer of power.

Former leader Mohamed Nasheed earlier led a rally in the capital Male to protest.

Mr Waheed has denied the claim, insisting that Mr Nasheed stepped down voluntarily.

Mr Nasheed’s resignation on Tuesday was followed by demonstrations and clashes in the Indian Ocean nation.

Meanwhile, UN Assistant Secretary General Oscar Fernandez-Taranco is holding talks with both sides to try to find a way out of the impasse.

‘Show for media’

“This is not an environment in which you can have free and fair election,” President Waheed told BBC Sinhala’s Saroj Pathirana on Friday.

“The country is divided on political lines, the former president is still agitating and you know he is free, he can move around wherever he wants to.”

Mr Waheed said the election campaign had already started for polls scheduled polls for the end of 2013.

“I think what is really important now is to calm down, make things settle down. And I have to demonstrate that we uphold the constitution and the rule of law.”

The new leader also said Mr Nasheed had acted “like a dictator” and was now trying to stage a “show” for international media.

Earlier on Friday, Mr Nasheed – who stepped down on Tuesday – got a rapturous reception from his supporters as he emerged from Male’s main mosque after prayers, the BBC’s Andrew North in the capital reports.

The supporters surged behind Mr Nasheed, as he led a rally through the narrow streets of the city, ending at his home, our correspondent says.

There he reiterated that he was no longer calling for his reinstatement as president, but wanted snap elections to resolve the stand-off.

‘Told me to write it’  

In a BBC interview, he said the new president should hand over power to the speaker of parliament in order to hold elections within two months.

And he repeated his claim that he had been ousted in a coup and was threatened at gunpoint.

“About 18 or so military personnel came up to me and said that if I didn’t resign in one hour they would resort to using arms,” Mr Nasheed said.

“They gave me a piece of paper and told me to write it – I wrote it and signed it, and they took the letter.”

Meanwhile, US State Department spokeswoman Victoria Nuland corrected the US’s position after saying on Thursday that the US recognised the new government.

“I got myself in a place yesterday that was not borne out by the facts,” she told a news briefing in Washington.

“We will work with the government of the Maldives, but believe that the circumstances surrounding the transfer of power need to be clarified,” she said.

“And we also suggest that all parties agree to an independent mechanism to do that.”

Robert Blake, the US assistant secretary of state for South Asian affairs, is arriving in Male on Saturday for talks.

At Friday’s rally, Mr Nasheed also complained of the arrest of several members of his party on the island of Addu – about an hour’s flight from Male.

Large numbers of soldiers and police with batons, helmets and tear gas canisters were deployed near the mosque in the capital.

So far, there has been no sign of the new government trying to carry out a warrant it says it has issued for Mr Nasheed’s arrest.

Mr Nasheed quit on Tuesday after police and soldiers joined opposition-led protests in Male.

On Wednesday, several thousand MDP supporters, led by Mr Nasheed, marched through the capital in protest at his ousting.

Riot police fired tear gas and broke up the demonstration – dozens of opposition supporters were arrested and several badly beaten.

Newly appointed Home Minister Mohamed Jameel has blamed Wednesday’s violence on Mr Nasheed’s party, and warned of filing terrorism charges.

The Tribune – Stay On DSGMC Polls, Sarna asks parties to file joint appeal

Amritsar, February 9. Delhi Sikh Gurdwara Management Committee (DSGMC) chief Paramjit Singh Sarna today extended an offer to all political parties, including the SAD, to join hands with him to file a joint appeal against the Delhi High Court stay on the elections that were scheduled to take place on March 11.

Talking to The Tribune, Sarna said, “Right from the Day One, the SAD is making a hue and cry over the issue and blaming me for the stay on the DSGMC polls. If they are so sincere to contest the elections on March 11, they should come forward and join hands with us in filing a joint appeal against the stay.”

Sarna claimed if the SAD thought they could improve their situation by delaying the polls, “they were highly mistaken”. He accused the SAD of resorting to legal recourse to hamper the DSGMC polls on various instances in the past as well since 1993.

On the fate of the appeal that the DSGMC planned to file against the stay, he said they had taken up the matter with the Delhi government. “We will certainly wait for the government’s next move over the stay before deciding our strategy.”

Sarna said there was no harm in going ahead with the elections and carrying out delimitation afterwards as it was a lengthy process. “Even the last assembly elections in Punjab were held when the delimitation process was on, but that didn’t come in the way of the poll process,” he said.

Responding to Sarna’s offer, SAD secretary Dr Daljeet Singh Cheema said, “He isn’t such a credible leader that we can rely on him. We sincerely want the elections to take place at the earliest, but for that we will make the best possible efforts on our own.”

The Tribune – 77 Punjab villages want liquor vends to go

Patiala, February 9. For a state given to liquor like fish in water, this may sound as a dry fact: 77 panchayats in Punjab want liquor shops in their villages shut or relocated. Under the Panchayati Raj Act, a village body has to pass a resolution and inform the Punjab Excise and Taxation Department (PETD) from April 1 to September 30 asking for restricting the sale of alcohol.

Senior PETD officials acknowledged that 77 applications had been received from villages in the state. A final decision to either shift these vends or shut them altogether will be taken by April 1.

According to official records available with the Excise Department, out of the 77 such villages, 54 are from Sangrur, 10 from Patiala, three each from Moga and Barnala, two from Mansa, one each from Jalandhar, Ludhiana, Gurdaspur, Ropar and Hoshiarpur.

“Two hearings have already been held. We’ll soon take a final call on the fate of these shops,” said Neelam Choudhary, Joint Excise and Tax Commissioner, Patiala. In the last financial year, authorities had closed liquor shops in 32 villages and shifted 10 outside the villages after receiving 72 resolutions.

“After the liquor vends are shut, an Excise and Taxation Officer (ETO) verifies the police record of a village to ensure that no illegal liquor is sold in the area,” said a senior officer.

Some NGOs and villages allege that the Excise Department rejected their applications under pressure from politicians as a large part of the liquor trade is controlled and operated by either politicians or their supporters.

Last week, following a resolution passed by panchayats in 2009 to shut liquor shops as part of their fight against alcoholism, film star Aamir Khan held a special video conference with the residents of Changal village in Sangrur.

The Hindu – India, Bangladesh to resume talks on Teesta Treaty

New Delhi, 10 February 2012. The treaty was put on hold after West Bengal CM protested against its provisions.

India and Bangladesh will take the first step towards revisiting the proposed Teesta river treaty when officials exchange river flow data at a technical meeting of the inter-governmental Joint Rivers Commission in Kolkata on Friday.

India had put the treaty on hold after West Bengal Chief Minister Mamata Banerjee, unhappy over the treaty’s provisions, pulled out of Prime Minister Manmohan Singh delegation to Dhaka last year.

Official sources here said the West Bengal government has been taken on board this time, which Ms. Banerjee’s aides had alleged was not the case when the Teesta Treaty was finalised. “The involvement of the West Bengal government is of paramount concern as far as the Government of India is concerned,” said the sources. In case of Teesta, both sides are also thinking of involving Sikkim, the uppermost riparian State.

“Essentially we are going ahead with different elements of reaching an agreement. The issue is not dormant,” added the sources.

While agreeing to put off the signing of the Teesta Treaty, Dhaka had asked New Delhi to ensure that the agreement would be examined after some time. An agreement is expected to pave the way for the signing of a similar agreement on the Feni river and five minor ones — Dudh Kumar, Manu, Khowai, Gomti and Muhuri.

The sources said West Bengal or any of the other State through which over 50 rivers flow into Bangladesh will be kept in the loop while signing water sharing agreements. The States were briefed and their advice taken during negotiations on a protocol on land boundary that was signed during Dr. Singh’s September 2011 visit to Dhaka.

In fact, senior officials from the Foreign Office here had travelled twice to Kolkata to brief the State government during negotiations on the demarcation of the entire land boundary and the status of enclaves and adversely possessed areas.

The Centre had also obtained the written consent of States and kept its negotiating brief within the parameters of their advice, especially from the West Bengal government, on taking “pragmatic steps”, which meant retaining the status quo, on enclaves and exclaves. “We had gone along with the West Bengal government’s desire to use Sui River for demarcation of the South Berubari sector,” said the sources.
