The Indian Express – Kathua rape-murder: Hindu outfit wants CBI inquiry to nab ‘real culprits’, seeks funds to plead case before Supreme Court

The group, seeking a CBI inquiry into the incident has also constituted a team of lawyers to file the due petition in the Supreme Court of India at the earliest.

New Delhi – India, 16 May 2018. The Hindu Ekta Manch has appealed to the public to donate funds so that a legal team is constituted to plead the Kathua gangrape and murder case before the Supreme Court.

The group, in a strong-worded letter, has appealed to find the “real culprits” in the rape and murder case of an eight-year-old girl in Kathua district of Jammu and Kashmir, which took place in January, this year.

The group also sought a CBI inquiry into the incident. “For ensuring this we have to constitute a team of lawyers to file the due petition in the Supreme Court of India at the earliest,” the letter reads.

“As all of us have realised that CBI enquiry has become a critical requirement in case real culprits have to be nailed and innocents falsely implicated in the case are freed. The CBI enquiry is also critically needed to unearth the bigger conspiracy behind the murder,” reads the contents of the letter made public by the Manch.

On Wednesday, Manch president Vijay Sharma said a decision to make public appeal for donations was taken at a meeting of the organisation. However, it has not evoked much response so far, he said, adding they would have to personally contact their friends and well-wishers to raise funds.

The letter further points out that the whole issue has been used to harass the people of Rasana and adjoining villages. It alleges that the people living in the area have had to abandon their homes and to shift to some other place.

“In case this happens there will be an immense boost to the Muslim demographic invasion of this area in particular and Jammu region in general. Changing the demographic complexion of Jammu is part of the Jihad being waged on Hindus,” the letter further stated.

“In the light of these dangers, forcing a CBI enquiry into the Rasana case assumes immense importance. We have to mobilise enough resources so that best legal team is mobilised to successfully plead the case before the Supreme Court of India.

We appeal everybody to come forward and donate generously so that a corpus of fund is created to meet the legal expenses,” says the letter signed by an advocate and five other members.

The Supreme Court on Monday had agreed to hear on May 16 a plea of three witnesses in the Kathua gangrape and murder case, accusing the Jammu and Kashmir Police of harassment and coercion.

On May 7, the top court had transferred the trial in the gangrape and murder case from Jammu and Kashmir to Pathankot in Punjab. However, the court refrained from handing over the probe to CBI, saying there was no need to do this as the investigation has been conducted and the chargesheet filed.

The eight-year-old victim, hailing from a minority nomadic community, had disappeared from near her home in a village close to Kathua in the Jammu region on January 10. Her body was found in the area a week later.

The Statesman – Kathua rape-murder: DSP Shwetambari Sharma slams lawyer’s misogynistic remarks

Shwetambri Sharma is the lone woman officer in the Special Investigation Team (SIT) of the Crime Branch of the Jammu and Kashmir Police that investigated the rape and murder of the eight-year-old.

New Delhi – India, 19 April 2018. Days after defence lawyer Ankur Sharma made a misogynistic remark about her, Deputy Superintendent of Police (DSP) Shwetambari Sharma has shot back at the prejudiced comments, saying “the whole nation will comment on it”.

Ankur Sharma, who is the defence lawyer of five accused in the case, while referring to DCP Shwetambari had said, “She is a girl, how intelligent can she be?”

As per a NDTV report, while reacting to Ankur Sharma’s remark, Shwetambari Sharma said: “It hurts when you are targeted and your intelligence is doubted just because you are a woman. What should I comment on such a chauvinist remark, the whole nation is there to comment on it.”

As per media reports, Shwetambari while talking to media highlighted the complexities in investigating the Kathua rape case.

She said, during the agitations, it was very hard to investigate the case. Collecting evidence and statements was very tough as the agitators were campaigning in support of the accused. The agitations led by pro-Hindu groups and lawyers bodies made it very difficult for the SIT to carry out their investigations.

However, DCP Shwetambari Sharma said she has full faith in the judiciary and “judiciary is capable enough to bring justice, don’t doubt it”.

Two FIRs have been lodged in the Kathua rape-murder case. One FIR against the eight accused in the case while the second one has been lodged against the lawyer’s body, which allegedly tried to stop the police from filling a charge sheet against the accused.

Shwetambri Sharma is the lone woman officer in the Special Investigation Team (SIT) of the Crime Branch of the Jammu and Kashmir Police that investigated the rape and murder of the eight-year-old in Kathua.

The eight accused men are facing chrges of holding an eight-year-old girl captive for a week in the village temple at Rasana in January, during which she was “sedated and sexually assaulted” before being beaten to death.

Dawn – Hundreds of protesters confront Modi in London

London – UK, 19 April 2018. Hundreds of noisy protesters greeted Indian Prime Minister Narendra Modi when he arrived in London on Wednesday.

Holding placards reading “Modi go home” and “we stand against Modi’s agenda of hate and greed”, they gathered outside Downing Street and parliament as Modi arrived for talks with Prime Minister Theresa May.

The demonstrators included Muslims and Sikhs, who called for end to religious persecution, and human rights activists, who called for end to violence against women.

Kashmiris held aloft flags, while others displayed posters depicting an eight-year-old Muslim girl, who was raped and murdered earlier this year in a brutal attack blamed on Hindu men.

“Lots of different groups are here,” said Dupinder Jit, a Sikh businessman. “What is happening in Modi’s regime is unacceptable, he is killing minorities.”

Sexual violence against women is a highly charged political issue in India, where protests regularly erupt about entrenched violence against women and the failure to protect them.

“The Indian government is doing nothing, and you feel sorry for the families because of the total injustice of it all,” said Navindra Singh, an Indian-born lawyer who lives in Britain.

“He has been in power for four years now and there has been no policy change to help protect women and children.”

Protests have erupted across India after the latest rape cases were reported. Police officers and a politician are under investigation in two of the unrelated cases.

In a crime that shocked India, an eight-year-old Muslim girl in the disputed region of Jammu and Kashmir was kidnapped, drugged and held for several days while she was raped repeatedly and then murdered.

In the other case, a state lawmaker from Modi’s Bharatiya Janata Party stands accused of raping a teenager. No action was taken against the politician until the girl threatened to set herself on fire earlier this month. Her father died soon afterwards from injuries he sustained while in police custody.

Modi addressed the outrage over the rapes last week by promising justice regardless of whoever the guilty were.

Nearly 40 per cent of India’s rape victims are children and the 40,000 reported rapes in 2016 marked a 60 per cent increase over the level in 2012. But women’s rights groups say the figures are still gross underestimates.

The Indian Express – Kathua rape-murder case: Gujjars, Sikhs take out rallies, demand death sentence for accused

Led by Choudhary Nazakat Khatana, a Gujjar and Bakerwal leader, Gujjars raised slogans against the Jammu and Kashmir High Court Bar Association over its call for a Jammu bandh on Wednesday seeking transfer of investigations into the case to the CBI.

Jammu & Kashmir – India, 13 April 2018. Gujjars and Sikh organisations on Friday took out separate marches seeking death penalty to those accused of the rape and murder of an eight-year-old girl in Kathua district.

They also demanded Chief Minister Mehbooba Mufti to sack her two cabinet ministers, Chander Parkash Ganga and Choudhary Lal Singh, for their support to the demand for a CBI inquiry during a rally of the Hindu Ekta Manch in Hiranagar.

“We demand justice for the girl. We demand death penalty to the accused,” Khatana said. Various Sikh organisations, led by Sikh United Front chairman Sudershan Wazir, also took out a candlelight march here. Wazir said that those demanding CBI inquiry for political gains were not doing justice to the soul of the minor.

He praised the Crime Branch for fair investigations, saying that not even one policeman would have been arrested otherwise.

Expressing surprise over family members of the accused demanding a CBI inquiry, which is usually demanded only by victims, Wazir said only two of the seven-member SIT were from the Kashmir Valley.
